How come the brakes on my Hyundai are so noisy?

And do you believe this explanation from the mechanic at my local Hyundai dealership. He told me that Hyundai uses asbestos linings in their brakes. In many cases, as in the case with my Hyundai Accent, the replacement brake linings do not work as well as the OEM asbestos linings.
My brakes are very noisy, and worst in wet weather and when the car is cold in the morning. Then when the brakes wear down, the noise is less noticeable. But then the brakes are worn and when I replace the brake pads the brakes are noisy again.

Hyundai recommends a brake service every 15,000 miles, especially in states where salt is used on the roads and when brakes are continually wet.

Rust forms quite easily in these conditions and more often than not, that is what you are hearing. When the vehicle is not in use, rust almost immediately starts to form. The initial noise you hear, is the rust on the rotor being scraped against the pads and then, the pads scraping the rust off the rotor when you apply them – which is why the noise disappears after a while.

It is normal, common and expected by Hyundai dealers. I think they could have explained it a little better to you though and they should have made you aware of the preventive maintenance for it.

The service they can perform will sand the pads, rotor and caliper, clean and lube the sliders (the metal clips that hold your pads in place), and then apply anti-squeal to the brake pads themselves. Not only does it help prevent rust buildup but it also prolongs the life of your pads.

It may be the Korean metal used in their rotors and pads – it’s hard to say why they rust so quickly. Going to Bendix or Raybestos should help – anything semi-metallic or ceramic should be much quieter.

How can I get my company on a insurance vendor list?

Hello, I am trying to get my environmental firm on a insurance vendor list. We cover all aspects of environmental work (i.e. mold, lead, asbestos, fire, water damage) and service the TRI-State area. I have done some research and made several calls, but have yet to find any helpful information. I am trying to exhaust all resources, so any advice would be greatly appreciated.

You should check out your local claims association. These are professional associations for insurance adjusters. Vendors are often associate members as well. There are also state associations. Get involved and get to know people.

You can also stop by your local claims offices and meet the adjusters. Call first and set up a time to drop by.
Bring documentation about your company and tell us why your company is different. What can you do for our insureds? After hours service? How fast can you get on scene? Are you able to do stick built homes and mobile homes (I have a heck of a time finding companies willing to work mobile home claims and I work a rural area…we’ve got a lot of mobile homes)

And if an adjuster gives you a shot on a claim….make sure you do a bang up job. Adjusters talk to each other. If you do a great job, we’ll pass your name onto others. If you do a rotten job….we’ll pass that on too (and we’ll never use you again).

As you know, the restoration business is very competitive. Many adjusters have a couple of companies that are their “go to” guys. I have 3 main ones that I use. The most recent “go to” guy is new to the area and trying to get established. I like him because he’ll tackle anything. (sewage back, mobile homes etc… the stuff the established folks would rather not do). He gets a crew on scene fast and does a very good job. And, he’ll do any size job. Big….small…he does not care. The little claims get treated with the same priority and importance as the big ones. I figure, if he’ll take such good care of my little claim customers….he’s going to do a great job with my big claims too.

If you can get in with an adjuster, they can tell you if they have a list and who is in charge of it. It really helps to take the time to develop a relationship with the adjusters.

Some companies have a list and require adjusters to recommend a company on that list. Others, let adjusters use/recommend what ever company they want. Again, if you can develop a relationship with the front line adjusters, you will be able to find out more about how each company operates.

Oklahoma has problems from excessive pig farming as they create a poisonous hydrogen sulfide gas from their waste lagoon’s, that suffer leaks and lethal spills. There are thousands of manufacturing facilities worldwide using water to carry away waste, infecting streams lakes and oceans, compounds can include asbestos phosphates nitrate mercury, lead sulfuric acid, caustic soda, sulfuric acid and petrochemicals. Thermal pollution with hot water from cooling towers is also a problem, this hot water waste is an inefficient use of power as the energy used to heat the water is lost, it could be harnessed.

Cruise ships holding thousands of people dump enormous amounts of very unsanitary waste water into the seas daily, affecting the oceans ecosystem greatly, there needs to be a solution for this water pollution, some major cruise lines have installed illegal bypass lines, depositing oil, sewage, garbage and other hazardous toxic wastes into the oceans and waterways, it is not only the cruise ships that dump waste overboard, causing polluted water.

Crisis Management – or managing the crisis?

There’s a world of difference between having a strategically
crafted crisis management plan in place and simply having to
manage a crisis, “from the back foot.” The world was served a
painful reminder on the subject, by the inept and vintage
cold-war era handling by Russian President Vladimir Putin, of
the Kursk submarine disaster.

Blunder number one was the (then) strangely paunchy Putin not
cancelling his holiday to, guideline number one: Be there. The
most senior possible person must always be dusted off and
wheeled out. The level of seniority demonstrates the seriousness
with which the issue is viewed.

The Russians are still locked into a quasi cold war mentality.
In which anything to do with the military is shrouded in a fog
of disinformation. That might have worked OK in USSR days, but
in the days of the media-enabled global village, there’s no
place for inept “spokespeople” adding to confusion and grief.
Guideline number two is: Tell the truth. There is no possibility
of having to argue later, like so many politicians, that you
were “misquoted” or that your comments were “taken out of
context.” Telling the truth, up front, is the simplest and most
effective way of defusing public hostility, however vexatious
the issue.

Many corporates fall into the trap of, “we can fix this
ourselves.” Sometimes you can’t. When it’s something requiring
outside or specialised help, it’s better to bring in early, an
excess of help, rather than too little, or none. Your public,
whoever they may be, will always be impressed by your “all hands
on deck” approach.

Guideline number three is: Tell them what you’re doing to fix
it. Bring the families or close ones of victims, or those
affected, to the heart of the operations control area if
possible and safe. Accommodate and feed them. Provide them with
communications to family and friends. Above all else, keep them
fully briefed. Think of then-Mayor of New York, Rudi Giuliani,
and his tireless communication with the media and those affected
by September 11th 2001. Corporate heads around the world can
learn from his example. Provide counselling, support and any
other facilities that might be needed to help the affected to
cope. Airlines now have this down to a formula.

So, guideline number four: Handle those affected, with utmost
sensitivity. Expect and treat their emotive outbursts with
empathy. They’re “normal”, given the circumstances. A South
African case in point is the insensitive media statement made by
the Everite (they of asbestos products notoriety) “Reputation
Management” spokesperson, via the media, to the bereaved, in
defence of his client. He said something to the effect that “the
circumstances surrounding the death are most unfortunate, but
future statements will be made only within the strict confines
of the law.” That truly is, as the Zulu aphorism says, “speaking
out of both sides of the mouth.”

Company responses such as this and those from Cape PLC – also
involved in slow-and-painful-death, asbestosis claims-related
issues, don’t win themselves any friends with such undiplomatic,
cavalier, hide-behind-the-legal-veil pronouncements. Remember
that potential investors today look to your triple bottom line
of fiscal, social and environmental performance and sensitivity.
Companies exhibiting scant regard for their past ill-doings,
deserve to go bust.

If ever there is a need for unambiguous, simple, clear
communication, this is it. Set up a communications task force
and ensure that they’re all at the same stage of familiarity on
the situation, at all times. Guideline five is: Sing off the
same, simple, song sheet. There’s nothing more awful than
conflicting views or “updates” on the situation. This can do
image and share price damage and anger the public – as did the
Russians, or years previously, those mismanaging the Exxon
Valdez oil spill disaster in Alaska. It will look as if you
don’t know what’s going on and haven’t got a handle on the
situation. Which clearly will be the case.

Guideline six is: Come up real quick with A plan showing how you
propose to avoid a repeat in the future. Think of the French
authorities and the Concorde crash. They swung speedily into
action – for which air crash investigations are not renowned -
and along with British Airways, grounded all Concordes until
designers came up with a fuel tank protection solution.

Guideline seven says: Don’t be tempted to lie or “cover” for the
boss or the corporation. South African National Minister of
Health, Dr Manto Tshabalala-Msimang, has made a right royal dolt
of herself, by refusing to make HIV/AIDS-related statements at
odds with those of President Thabo Mbeki. This guideline is not
in conflict with the “sing off the same song sheet” dictum. It’s
a warning to remember that your responsibility does not include
“covering” for someone else’s maverick stance. When they’re
discredited, so will you be. This may pose a moral and career
dilemma for you. Look long-term before you act.

Guideline eight is: Go the added mile. Deliver the unexpected,
go beyond the requirements of the situation. Set up a trust.
Establish a bursary fund. Create an institution. Shell, Sappi,
Sasol and numerous other environmental sinners have very
cleverly implemented wild life, ornithological or other
environmental awareness programs. You may have noticed the
inordinately frequent flighting of Shell “environmental
friendliness” commercials during Discovery Channel’s damp-squib
Egyptian, “drill through the pyramid wall” broadcast. These
“show that they care” about the environment, right? Well, that
stuff works on unthinking people, even if it does mean sailing a
tad close to the wind at times. Thank God for Greenpeace though,
to keep the record straight.

Guideline nine: When it’s good, localise or take credit for it.
When it’s bad, globalise it and “share the problem.” Example:
You’ve had (as did Shoprite Checkers, following the acquisition
of OK Bazaars) a dreadful year, because OK Bazaars “shrinkage”
had dented their bottom line. Globalise by stating quite
truthfully that no retail chain in the world is impervious to
staff theft. Tell ‘em that the people in the newly acquired
company were disaffected and demotivated and hence, destructive.
Then localise, and say what you’ve done to reassure and
remotivate the staff, and improve the security aspect. So you’re
sharing the bad and claiming the good. You should not attempt to
do this dishonestly, or hide the real story. It’s simply being
candid – but intelligently so. Tony Blair did this well, when
discussing the intoxicated and very public behaviour of his
errant son, Euan.

Guideline ten is: The media is your umbilical cord to your
public. You need to be available to the women and men of the
media day and night. You should set up a media crisis centre.
Appropriately catered with food, plenty of caffeine and
non-alcoholic beverages. The American mine management and their
State Governor did well with the coal-mine cave-in in
Pennsylvania. TV viewers valued seeing the pale, drawn,
exhausted, bags-under-the-eyes Governor, investing some “sweat
equity.”

As they did, you should have someone senior and diplomatic from
your corporate affairs team, on duty at all times. Don’t be
smart with the media. Don’t try to feed them “spin.” Don’t think
you can manipulate them. Don’t put them down, or belittle their
perspectives. The better you keep them in the loop, the less
vitriolic they’re likely to be. You need them at this time more
than any other. How you treat them will be reciprocated. If you
don’t already have a media relations program underway, you’d
better start one. You don’t know when you’re going to need it.
Don’t use a crisis as your getting-to-know-the-media opportunity.

The bottom line? What I call the “three A’s.” Acknowledge or
admit to the situation. Specify what Action you’re taking right
now to contain or repair the damage. Tell them what you’re going
to do to Avoid a repeat in the future. If you don’t, you might
well be blowing the accumulated benefits of your combined
marketing, advertising, and communications budgets and efforts,
in one fell swoop. You don’t have to.

Sure, a “non-professional” can hire sub contractors and buy materials but it’s going to be harder for someone to comprehend all the aspects of the construction process the same way a professional does.

I could probably learn how to do brain surgery too! But I’m not sure you would want to be my first patient!!!

According to Dr. K. Anders Ericsson, a Conradi Eminent Scholar and Professor of Psychology at Florida State University who is widely recognized as one of the world’s leading theoretical and experimental researchers on expertise, it takes about 10,000 hours of practice to reach the level of expert.

Expert – 10,000 hours – that means 250 weeks @ 40 hours or 5 years.

Technician – 5,000 hours to be very accomplished

Advanced – 2,000 hours you become pretty good

Layperson – has little or no practice in a field

And we are not just talking about expertise in hundreds of different construction trades and techniques, but also the Building Code, local rules and regulations, human relations, management, legal issues, safety, and political savvy.

Flow of work

Have you heard of a construction job that took longer than it was supposed to?? Unfortunately it seems to be the practice not the exception… Did you see the movie “The Money Pit” (a must see if you haven’t!)? “Two weeks” is the answer to every question about how long it will take. Obviously, some smarmy contractors are at fault here. However, the client also has a responsibility to bear. The number one reason jobs slow down (assuming an attentive and professional builder is running them) is lack of appropriate information. The plans aren’t specified properly. The owner hasn’t finalized a decision.

When the flow of work is mismanaged or changed, it can have a devastating effect on a job. The longer a job takes the more it costs – interest cost, overhead and rental costs to name a few. A well run job requires a good “helmsman” steering the way. Changes are inevitable in a custom home but the fewer the better. Good planning helps a huge amount, but when there is a change, the contractor needs to steer the appropriate change through design, permitting (if necessary), pricing, scheduling and execution to get the job back on track.

Sub contractors work differently than general contractors and it is important to understand this relationship. A sub may have 5, 10 or 20 jobs going on at a time and if a job changes or isn’t ready when the sub is told to be there, it wastes time (time is money) for the sub. Inexperienced contractors fall into the trap of not having the job prepared or the appropriate specifications or materials available.

Quality

Aside of overseeing the flow of work, a good contractor has a solid understanding of all phases of construction and (hopefully) design. The contractor needs to know everything from what makes a good foundation installation – items such as clearance to rebar – to the particular type and quality of a piece of wood – quarter sawn, rift cut, hard or soft. What makes a quality tile installation or retaining wall waterproofing system. The practices change in different parts of the country and different climates.

The contractor must understand the ever-changing building codes and regulations. He also needs to maintain a safe job site and insure all sub contractors follow the same practices.

Certainly building a home is not brain surgery, but just like every other profession, it looks easier than it is. If you want to take on building your own home there are many good books available to help you get started. In addition, research other ways to build such as getting the assistance of a builder as a consultant or hiring an experienced building supervisor. Whichever way you go – learn what you can ahead of time. Even if you hire a contractor, you will still be heavily involved and making 1,000’s of decisions to get the custom home you want.

If you are in the construction business or employed by an industry that uses products containing asbestos, you may wonder “Are asbestos fibers visible to the eye”? Generally asbestos fibers are too small to be seen by the naked eye. Asbestos becomes dangerous when it has broken down into small fibers and is inhaled. It is nearly impossible to detect the presence of asbestos without taking the material to a lab for testing. A lab technician will put the material under a microscope to search for asbestos fibers. Asbestos does not cause an immediate reaction. It will not cause you to cough, sneeze, or your eyes to water. You cannot see, smell, or taste asbestos. If you skin becomes contaminated with asbestos it will not burn or itch.

Asbestos related diseases have a very long latency period. This is the time frame from when you are first exposed to asbestos until you become ill. Most persons do not become ill for at least ten years after exposure and some not until over forty years later. Asbestosis, lung cancer, and mesothelioma are all asbestos related diseases. Asbestosis occurs when asbestos fibers enter the lungs. The body will naturally produce an acid to combat the fibers. However, this acid can cause scarring in the tissue of the lungs and in advanced stages breathing becomes more difficult and painful. Asbestosis was first documented in shipyard workers. Asbestos can also cause lung cancer. If a person smokes and is exposed to asbestos, they have a much greater chance of developing lung cancer. Mesothelioma is a type of cancer that has only been linked to asbestos exposure. It is a cancer of the cells that line the peritoneum (area surrounding the abdominal organs) and the pleura (area outside of the lungs and inside of the ribs).

There is a lot of debate and controversy surrounding which types of asbestos is harmful. Some types of asbestos are thought to be more dangerous than others but all types of asbestos exposure should be avoided. Actinolite, amosite, anthophyllite, crocidolite, chrysotile (white asbestos), and tremolite are all types of asbestos. Chrysotile is the type of asbestos most commonly used in manufacturing products.

Asbestos fibers are not visible to the eye. If you feel you may have been exposed to asbestos, the most common method for testing is a chest x-ray. The x-ray will not show the asbestos fibers but it can spot early signs of lung disease. There is no known cure for asbestos related diseases.

Asbestos Problem Plagues Philadephia Housing Authority

Illegal removal and disposal of asbestos pipes has placed the Philadelphia Housing Authority in hot water for potentially exposing employees and the public to the possibly hazardous material

Plumbers removed leaky pipes from a resident’s home and left the rusty pipes – covered in a white gauzelike material – on the front patio. One resident removed the asbestos-covered debris with her bare hands, disposing of the pipes in her normal garbage.

The white gauzelike material may be asbestos, a hazardous substance with potentially deadly consequences if torn or disturbed. Asbestos exposure has been linked to the lung cancer mesothelioma, asbestosis, and other serious health related diseases.

This is one of many cases that have been alleged against PHA workers, who may have been responsible for improperly removing and disposing of asbestos covered heating and plumping pipes.

Local and federal laws state only trained professionals are licensed to remove and dispose of asbestos in public buildings. Asbestos debris must be enclosed in a sealed bag and then transported to special landfills.

Because of the implications, the U.S. Environmental Protection Agency has launched a formal criminal investigation researching the allegations. PHA may be liable for putting many at risk of asbestos exposure if the allegations prove to be true.

Former employees have also files complaints against the housing authority, backing the current allegations. Some employees, such as former PHA plumber, David Poulterer, accuse the PHA of suspending them without pay for complaining about the illegal asbestos handling.

The city Health Department also found asbestos fibers in apartments that the PHA had reported were clean of asbestos fibers. The Health Department has demanded that the PHA return and re-inspect the homes due to the discrepancy in the reports.

The Philadelphia Daily News reported a resident described the experience. Channel Saunders claimed that the PHA was “much more concerned about me talking to the Daily News than about the health and safety of me and my children.” Saunders resides in one of the affected apartments with her four children, aged 9, 5, 2 and 2 months.

Because mesothelioma typically manifests 20 or 30 years after exposure, it is difficult to accurately determine how these recent events will affect those involved. Ongoing investigations will determine the asbestos level and whether additional apartments may be at risk as well.

Workers Compensation in Chicago,il?

I worked in an Asbestos Removal Company for 17yrs. In April ‘06 I had an accident working for this company. It was in an 8th levels and 72in wight space. I was in the fourth level, other worker was in the second floor and the supervisor and other two persons were in the first floor when all of a sudden I saw fire coming from the first floor. I was trying to find an exit going up but all the emergency doors were locked, I got all the way to the eight floor then I don’t know what happened. I was in the hospital unconscious for six days. May ‘06 I went to see a lawyer to sue the company he told me that I could sue the company and the owner of the building since then I have been receiving a check from Workers Compensation. One month ago the lawyer call me and said the he was not going to take the case to sue the building that if I wanted I could talk to another lawyers but i already talk to other lawyers and no one wants to do it. Is there something else that i can do. Thank you.

Yes, you can hire a lawyer *at your own expense* to pursue the matter, if you have the money to do so. You can see if you can file suit pro se (representing yourself,) if you want a fool for a client.

The key issue is: Why did the lawyers refuse to take your case?

My guess is they looked at your claim and determined they couldn’t win it for you, hence no contingency fees. Or that the odds were heavily enough against to not make the labor worthwhile on that basis. And if multiple lawyers decided they couldn’t win it on contingency, you probably have no hope of being successful

Nothing says a lawyer must take your case, triply nothing says a lawyer must act on a contigent fee basis. So hire one out of your own pocket, if you can, or keep going until you either find a lawyer who will take it for nothing or run out of lawyers.

Maybe you should be grateful for having Work Comp approved and let it go.
